This depends on what the complaint is all about, whether it is true, or just an accusation.Unless you are guilty of some misconduct which can lead to your termination, I would defend myself against the complaint.

A Human Resources claim? Pink slip? Write up? I do not quite understand your question, but I would not quit, I would let them term me and then file for unemployment and if the company fights the claim for benefits then I would appeal it.

By awaiting termination means you are sure about the result of the HR claim against you. It is not understood, why you feel so. But, in my views you must face the action boldly to justify your stand and quit the job honourably after you win the case, so that your prestige and honour do not become at stake while seeking another job. This way you can even satisfy your interviewer for the next job when asked why did you leave the last job. You would be able to say with full confidence that the previous employer was in the habit of leveling false allegations on account of which you had to leave the job after winning your case and you did not want to work with such an unethical and immoral employer. You should cooperate and defend your actions, if you did nothing wrong. However, if you believe you are about to be terminated, you should admit your wrong and ask for mercy. Remember if you quit, you may be barred from collecting unemployment compensation.
